Data protection

Responsible Party

The data controller responsible for processing personal data on this website is GAMMACATERING AG, Bösch 43, 6331 Hünenberg, Switzerland (email: zug@gammacatering.comFor visitors from the EU/EEA, the EU General Data Protection Regulation (GDPR) also applies.

Privacy and personal data are protected. The processing of personal data belonging to guests, customers, suppliers, partners and other users is limited to the data required for the optimal provision of our services. Personal data is collected, processed and used in accordance with the content of this privacy policy and applicable data protection regulations, in particular the revised Swiss Federal Act on Data Protection (revFADP) and, where applicable, the GDPR. This privacy policy sets out which personal data is collected, processed and used.

1. Description and scope of data processing

1.1 Personal data within the meaning of this privacy policy is any information relating to an identified or identifiable natural person (hereinafter "data subject"). This includes, in particular:

  • Name, email address, postal address and telephone number;
  • The details you provide in our enquiry form (see section 1.4).

1.2 Personal data also includes information on the use of the website, e.g. the volume of data transferred, the location from which the data is accessed, as well as other connection data and accessed sources. This is generally done using log files and cookies. Further information can be found in section 4.

1.3 As a matter of principle, personal data is destroyed or anonymised as soon as it is no longer required for the purpose of processing and no statutory retention obligations apply.

1.4 Enquiry form: If you use our enquiry form, we process the details you provide (first name, surname, email address, telephone number, address, as well as details of your event: type, date, number of guests, venue/location, additional services, budget range and free-text comments) in order to process your enquiry and provide you with a quotation. Your enquiry reaches us by email (to zug@gammacatering.com); you automatically receive a confirmation copy at the email address you have provided. We additionally store the enquiry in our website system for processing and record-keeping purposes. Emails are sent via our provider IONOS (see section 6). Legal basis (EU/EEA): Art. 6(1)(b) GDPR (pre-contractual measures).

2. Purpose of use

Personal data is generally used for the following purposes:

  • Processing your enquiry and the optimal provision of services to the guest/customer;
  • Secure, effective and customer-friendly operation of the website;
  • Conducting recruitment procedures (applications by email);
  • Anonymous traffic/reach measurement and, where you have given consent, marketing purposes (see sections 4.3 and 4.4).

3. Principles of data processing

When processing data, we observe the principles of lawfulness, proportionality, purpose limitation, transparency – in particular the fulfilment of information obligations – and data security.

4. Information regarding the user's computer, cookies

4.1 Server log files

Each time the website is accessed, the following information is generally collected: the IP address, the browser's request, and the time of that request. In addition, the status and the amount of data transferred are recorded. Product and version information about the browser and operating system used are also collected, as well as the website from which access occurred. This data is used to operate the website – in particular to identify and resolve errors, and to determine load levels and make improvements. Log files are deleted or anonymised after 14 days.

4.2 Cookies and consent management

Cookies are information files stored by the web browser on the user's computer. We use Borlabs Cookie to manage your consents; this stores a technically necessary cookie that remembers your cookie selection (no consent required for this cookie). Your consent decision is logged for evidentiary purposes. Further cookies are only set if you actively permit the relevant category (e.g. marketing, for the Meta Pixel); our traffic measurement tool (Matomo) operates without cookies. You can adjust or withdraw your consent at any time via the cookie settings and can generally restrict cookie storage in your browser.

4.3 Traffic measurement with Matomo (cookieless)

For statistical analysis of website use, we use Matomo – an open-source analytics tool that we operate ourselves on our own server. No data is transmitted to third parties. Matomo is configured to operate without cookies and does not create a cross-device profile. Your IP address is shortened before storage (the last two octets are removed), so that it cannot be traced back to you personally; your browser's "Do Not Track" setting is respected. Due to this data-minimising configuration, traffic measurement is permitted without consent (Art. 6(1)(f) GDPR).

4.4 Meta Pixel (only with consent)

Where you consent via the cookie banner, we use the Meta Pixel provided by Meta Platforms Ireland Ltd. to measure the success of our advertising on Facebook/Instagram. This may involve data (including IP address, information about your visit, and cookie identifiers) being transmitted to Meta, potentially including transfer to the USA; Meta relies on the EU-U.S. Data Privacy Framework and/or Standard Contractual Clauses for this purpose. The Pixel is only loaded following your active consent. You can withdraw this consent at any time, with effect for the future, via the cookie settings (Art. 6(1)(a) GDPR).

4.5 Embedded program libraries (CDN)

For the display of the website, we use JavaScript/CSS libraries (Splide, GSAP, Lenis) loaded via the content delivery networks jsDelivr, Cloudflare (cdnjs) and unpkg. Your IP address is technically transmitted to the respective provider as a result, which may include transfer to the USA (Art. 6(1)(f) GDPR).

5. Data security

All information transmitted through use of the website is stored on servers within Switzerland/the European Union. As the transmission of information over the internet is generally not entirely secure, the security of data transmitted via the internet cannot be guaranteed. However, the website and other systems are protected by technical and organisational measures against loss, destruction, access, alteration or disclosure by unauthorised persons. Data is only transmitted to third parties and third countries within the scope of sections 4.4, 4.5 and 6.

6. Disclosure of personal data and data processors

Your personal data is not sold to third parties or passed on for their own purposes. Processing by third parties only takes place in the following cases:

  • By carefully selected data processors who process data on our behalf: our hosting provider [hosting provider, country] and our email provider IONOS SE (Germany), via whose servers form and contact emails are sent;
  • To Meta Platforms Ireland Ltd., where you have consented to the Meta Pixel (section 4.4);
  • For technical reasons, to CDN providers when loading embedded program libraries (section 4.5);
  • Where we are legally obliged to do so, or where an official or judicial order exists (e.g. for the purposes of law enforcement, hazard prevention, or the enforcement of intellectual property rights).

Transfers to countries outside Switzerland/the EU only take place where an adequate level of data protection exists, or on the basis of suitable safeguards (e.g. the EU-U.S. Data Privacy Framework, Standard Contractual Clauses).

7. Changes to this privacy policy

We reserve the right to amend this privacy policy at any time, with effect for the future. The current version is always available on the website. To stay informed of the applicable privacy policy, please check this website regularly.

8. Rights of the guest/customer/applicant

You have the right to request information about the personal data processed — in particular the personal data itself, the purpose of processing, the retention period or the criteria used to determine it, the origin of the data, and any recipients or categories of recipients. You furthermore have the right to rectification, erasure and restriction of processing, to data portability, and the right to object to processing and to withdraw any consent given at any time, with effect for the future. You also have the right to lodge a complaint with a supervisory authority – in Switzerland, with the Federal Data Protection and Information Commissioner (EDÖB, edoeb.admin.chedoeb.admin.ch); in the EU/EEA, with the data protection authority responsible for you.
