TERMS AND CONDITIONS

GAMMACATERING AG undertakes to carry out the assignment with the utmost care and reliability. It undertakes to meet deadlines and to deliver the event on time and in accordance with the agreed assignment. The selection and preparation of food and beverages is carried out to the highest quality standards. GAMMACATERING AG is certified for sustainability compliance. It strives to minimise food waste. Wherever possible, seasonal products, reusable items and short supply routes are taken into account.

When organising events, GAMMACATERING AG coordinates the participating service providers and directs the overall event, provided this has been agreed with the client (see section "Consulting • Event Direction").

All rights to the ideas, proposals, drafts, sketches, images and texts presented remain the intellectual property of GAMMACATERING AG. Their use is only permitted with express consent.

An assignment with GAMMACATERING AG may be made verbally or in writing. The assignment is concluded, at the latest, upon written order confirmation by GAMMACATERING AG. Any services beyond those covered by the order confirmation (subsequent requests, changes on the part of the client, additional work, etc.) will be invoiced separately.

GAMMACATERING AG prepares the first two quotations free of charge. From the 3rd quotation onwards, a processing fee of CHF 250.00–CHF 600.00 per assignment will be charged in the event of cancellation (depending on the scope of the assignment). Cancellations of bindingly reserved dates are subject to a charge equal to the costs incurred up to that point.

A tasting is generally possible. Costs are charged to the client based on the scope of work involved. The minimum amount is CHF 100.00 per person, including wine pairing.

GAMMACATERING AG reserves the right, in the event of short-term changes in market supply – for example due to a lack of goods on the market or significantly increased prices – to modify its delivery-related services, in consultation with the client. It undertakes to provide an equivalent fulfilment of the assignment.

Any change to the number of participants for the meal must be communicated no later than 7 days before the event, in writing where possible. A subsequent reduction below this number cannot be taken into account.

In the event of cancellation of an event after the assignment has been placed, the following costs will be charged:

GAMMACATERING AG is entitled, if necessary, to have the contractual obligations fulfilled independently by a third party or to engage a third party. The third party must be equally or similarly capable of carrying out the assignment. In such cases, GAMMACATERING AG undertakes to carefully select and instruct the third party.

Provided the damage/loss was not caused by GAMMACATERING AG itself, it is entitled to charge the client for any costs relating to its own property as well as to material explicitly rented from third-party companies for the event.

GAMMACATERING AG offers the client advisory and support services on request. GAMMACATERING AG charges a service fee for these services. Advisory services are agreed either on an hourly basis or as a flat fee, depending on the event. Taking on the role of event direction is charged as a service fee amounting to 10–15% of the total invoice amount (including third-party services). The percentage charged depends on the associated workload.

Contracts with third-party service providers are organised by GAMMACATERING AG. The contract is formed between the end client and the service provider. In exceptional cases, such contracts may be concluded as an integral part of GAMMACATERING AG's order confirmation. In this case, the full amount of the third-party services must be covered by the advance payment. In the event of cancellation, the general terms and conditions of the respective parties/third-party service providers apply.

GAMMACATERING AG requires an advance payment prior to the event taking place. This advance payment normally amounts to 60% of the total amount, payable no later than 10 working days before the start of the event. The balance is payable within 10 working days of the conclusion of the event, including any additional services, based on the detailed final invoice.

The place of jurisdiction for the assessment of all disputes arising from this contract is Zug, or another competent jurisdiction of GAMMACATERING AG's choosing. Swiss law applies.
